Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Fiyr websites, mobile applications, AI receptionist features, and related services (collectively, the “Services”) provided by Fiyr, Inc. (“Fiyr,” “we,” “us,” or “our”).

By creating an account, downloading the app, or using the Services, you agree to these Terms. If you use the Services on behalf of a business, you represent that you have authority to bind that business.

1. The Services

Fiyr offers tools for appointment scheduling, staff and customer management, online booking links, POS and payments (where enabled), reporting, and optional AI receptionist features that can answer calls and SMS to book appointments using your business configuration.

We may modify, suspend, or discontinue features with reasonable notice where practicable. Beta or early-access features may be provided “as is” with limited support.

2. Accounts and eligibility

  • You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account.
  • You are responsible for safeguarding credentials and for all activity under your account.
  • You must provide accurate registration information and keep it current.
  • You may enable additional staff users; you are responsible for their use of the Services and permissions you grant.

3. Subscriptions and payments

3.1 Plans and billing

Paid plans (e.g., Pro, Team) are billed in advance on a recurring basis unless otherwise stated. Fees are shown at checkout or in-app. Taxes may apply.

3.2 Free trials

We may offer free trials. Unless you cancel before the trial ends, your subscription may convert to a paid plan and you authorize us (or our payment processor) to charge the applicable fee.

3.3 Payment processing

Card payments you accept from your customers through supported terminals or POS features are processed by third-party payment providers. You must comply with their terms and applicable card-network rules.

3.4 Refunds and cancellation

You may cancel a subscription through account settings or by contacting support. Cancellation stops future charges but does not entitle you to a refund for the current billing period unless required by law or stated in a separate offer.

4. Your content and customer data

You retain ownership of content and data you submit (“Customer Content”), including customer profiles, appointment records, and business configuration. You grant Fiyr a worldwide, non-exclusive license to host, process, transmit, and display Customer Content solely to provide and improve the Services, including operating the AI receptionist on your behalf.

You represent that you have all rights necessary to submit Customer Content and that your use complies with applicable law (including privacy, marketing, and telemarketing rules).

5. AI receptionist

  • The AI receptionist is designed to assist with booking and FAQs; it may make errors. You remain responsible for your business operations, pricing, availability, and customer relationships.
  • You must configure accurate hours, services, and policies and review bookings as appropriate.
  • You are responsible for lawful use of call forwarding, recording, and SMS, including any notices or consents required in your jurisdiction.
  • We may use subprocessors to provide voice, SMS, and AI capabilities.

6. Acceptable use

You agree not to:

  • violate law or third-party rights;
  • upload malware or attempt unauthorized access to the Services;
  • reverse engineer the Services except where permitted by law;
  • resell or sublicense the Services without authorization;
  • use the Services to send spam or harassing communications;
  • misrepresent your identity or business;
  • use the Services for illegal gambling, adult content, or other prohibited industries we designate.

We may suspend or terminate accounts for violations.

7. Intellectual property

The Services, including software, branding, and documentation, are owned by Fiyr and its licensors and protected by intellectual property laws. These Terms do not grant you any rights except the limited license to use the Services as intended.

Feedback you provide may be used by us without restriction or compensation.

8. Third-party services

The Services may integrate with third-party products (e.g., identity providers, payment terminals, printers). Your use of those products is governed by their terms. We are not responsible for third-party services.

9. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIYR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.

Fiyr is a business software tool, not a medical, legal, or financial advisor. If you handle regulated data (e.g., protected health information), you are responsible for compliance with applicable regulations.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIYR AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID TO FIYR IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

11. Indemnification

You will defend and indemnify Fiyr against claims arising from your Customer Content, your business’s use of the Services, your violation of these Terms, or your violation of law (including customer privacy or telecommunications requirements).

12. Termination

You may stop using the Services at any time. We may suspend or terminate access for breach, risk, non-payment, or discontinuation of the Services. Upon termination, your right to use the Services ends. Sections that by nature should survive (e.g., liability, indemnity, dispute resolution) will survive.

You may export data before closure where the product supports it. We may delete data after a retention period as described in our Privacy Policy.

13. Dispute resolution

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules, except where mandatory consumer protections in your country apply.

Any dispute will be resolved in the state or federal courts located in Delaware, and you consent to personal jurisdiction there, unless applicable law requires otherwise.

14. General

  • These Terms, together with the Privacy Policy, Cookie Policy, and Security page, form the entire agreement.
  • If a provision is unenforceable, the remainder stays in effect.
  • Our failure to enforce a provision is not a waiver.
  • You may not assign these Terms without our consent; we may assign them in connection with a business transfer.
